It sounds like you have air/moisture leaking in from the outside. This creates a ideal enviroment for mold. If you have a warranty with the home, let them handle it. Otherwise you need to find the source of the air and seal it off. then kill the mold (a water/bleach spray works well). If its a visible area prime with a killz type paint then paint Priming with killz may be a good idea anyways. As the weather warms the source may disapear till fall sets in, make sure you find it.

We need more info to properly answer your concerns.

Like:

-Are the basement walls 'above grade' or 'below grade'?

-Are they framed, poured concrete, concrete masonry units or other?

-What type insulation? Faced fiberglass? Rigid foam? Pillow insulation? Other?
-----If faced fiberglass, is the insulation covered with taped and finished drywall as required?
